Divorce: More Than Just Ending a Marriage

Divorce is often seen as the final step in ending a relationship, but it’s important to understand that it is a legal process separate from resolving financial matters and parenting arrangements.

In Australia, you can apply for a divorce once you have been separated for at least 12 months and there is no reasonable likelihood of reconciliation. The Court does not consider who was at fault for the breakdown of the marriage.

Obtaining a divorce does not automatically finalise property settlements or parenting arrangements. These issues are dealt with separately, and there are important time limits to be aware of. In most cases, applications for property settlement or spousal maintenance must be made within 12 months of a divorce becoming final.

Seeking legal advice early can help you understand your rights, meet important deadlines, and make informed decisions about your future. Every family’s circumstances are different, and having the right guidance can make the process smoother and less stressful.
